GENERAL TERMS OF SALE

 

 

Article 1. Implementation of the General Conditions of Sale

 

These Conditions of Sale apply to sales made between,

On the one hand, any responsible private individual residing in France or different European countries, making a purchase through the store site www.jingo.fr and,

On the other hand,the company JINGO Sarl.

As a result, they apply automatically to all orders placed on the website jingo.fr owned by JINGO Sarl.

Article 2. Products

 

The product offers are available on the site www.jingo.fr. These offers are governed by the following conditions of sale which are valid as long as they remain on- line and until the products are available.

The products offered for sale on the site www.jingo.fr are described with the greatest possible accuracy. All photos, texts and drawings associated with the products shown are only indicative and are not contractual; sometimes it may exist minor differences with the final product delivered to the customer.

 

Article 3. Ordering

 

Any order placed on the site www.jingo.fr causes express acceptance of these Conditions of Sale and implies acceptance of prices and products available for sale.

 

Order Process:

The customer who wishes to place an order must follow the following procedure:

 

1. Product Selection: you must select the product you wish to order;

 

2. Checking the contents of your selection: checking the contents of your cart while keeping the possibility of eliminating the products you have selected;

 

3. Identification: You must fill in the form of identification made available to you and enter the requested information (required information: civility, name, address, e-mail, password, phone number for delivery);

 

4. Check your order: you check the contents of your order, the total price, the shipping and billing addresses while keeping the possibility of removing a product or changing the billing and delivery addresses;

 

 

5. Choice of payment: you choose your mode of payment;

 

6. Confirmation: You must confirm your acceptance of these terms and conditions of sale by checking the box. The validation of the order is possible only after ticking the box;

 

7. Referral to the site of the CIC to secure the payment (SSL): You must give the necessary bank details for payment. Your account will be debited within 6 days following your order;

 

8. Acknowledgement of the order: you receive an e-mail summarizing the contents of your command, namely:

-- The number of your order;

-- The list of products ordered;

-- The arrangements for delivery.

 

We advise you to save and print this document, official proof of your order. Your order is then recorded and processed by our sales administration department which verifies the availability of the ordered products. Any order placed constitutes acceptance of prices and descriptions of products available for sale. JINGO Sarl agrees to fulfil orders received on its website only within the limits of available stocks.

 

In the event of unavailability of ordered products, JINGO Sarl will contact you by phone or e-mail as soon as possible to agree with you the outcome to give your order:

-Sending of available product(s) in a new approximate time of delivery, or

-Cancellation and refund of the order.

In the case of a reduction or cancellation of an order (by unavailability of the products), the amount of your banking transaction (done via the secure site of our partner CIC) will be amended or cancelled accordingly to match the items finally ordered.

Article 4. Price - Payment and security

 

Prices are those in force on the day of the order. All prices are quoted in euros, including VAT (TTC), excluding contribution to shipping and handling costs. (See conditions for the country).

Delivery costs will be mentioned in the "basket" during validation of the order.

JINGO Sarl keeps the right to change its prices at any time. The products are billed on the basis of the price list in force when the order was validated by the customer.

 

Payment:

For credit card (Visa, VISA, MasterCard): in this case, the payment is made on the site of  CIC. This implies that no banking information concerning you is transmitted via the site www.jingo.fr

The payment by credit card is perfectly secure (SSL). Your order will be registered and validated upon acceptance of payment by the banking service.

 

 

 

 

Security:

The data of your credit card are coded using SSL (Secure Socket Layer) and do never pass clearly on the network. The payment is directly made at the bank. JINGO Sarl has in no case access to these details and does not hold it on its servers.

 

Property transfer:

The products remain the property of JINGO Sarl until the full payment of the price will be cashed by JINGO Sarl. However after delivery, the risk of the goods is transferred to the customer.

 

Failure to Pay:

JINGO Sarl reserves the right to refuse to make a delivery or meet an order from a consumer with whom a payment dispute is pending.

 

Controls anti-fraud:

To ensure the security of transactions and respond to the concern of many people regarding the prevention of fraud in e-trade, JINGO Sarl controls regularly orders that have been validated on its online sales site www.jingo.fr. These controls are designed to protect JINGO Sarl from abusive practices in relation to on-line payments. According to those procedures, our services may need to ask you to transmit documents necessary for the release of your order: proof of identity, home address, debit in your name, etc...

These requests are made by e-mail and we invite the customer to send us by e-mail or fax, these documents (the aim being to ascertain the real identity and home address) for issuing his order. In case of lack of evidence or if the documents sent can not ascertain the identity of the purchaser and the reality of domicile, we would have to cancel the order to ensure the safety of online transactions.

 

Article 5. Terms of delivery

General:

The products purchased on www.jingo.fr are delivered only in France and some European countries. The products are delivered to the shipping address you provided during the ordering process. The mentioned delays are estimated and correspond to standard shipping and handling process.

 

Shipping costs:

The costs of shipping and handling are managed under a package.

The costs of shipping and handling are free for orders above a certain amount. (See conditions for the country)

The costs of shipping and handling will appear on the summary of your order before validation. This amount will be due in addition to the price of the purchased products.

 

Delivery delay:

For all products, the order is prepared for a departure from our warehouses within a maximum of 72 hours (subject to availability of stocks) after the confirmation by e-mail of your order. The delivery is done by our carrier within the approximate average delay of 3 to 6 days. The average time between order and delivery is 3 to 10 days.

The average time of delivery depends on the destination and the availability of the product. Exceeding this period may not give the right to any cancellation of the order, any reduction of the price paid by the buyer, and any payment for damages.

However, in accordance with the clauses of article L.121-20-3 of the French Consumer Code for lack of delivery at the expiration of thirty days from the date on which you placed your order, you will be able to cancel your order without charge. The money you have paid will be reimbursed.

If possible, JINGO Sarl keeps the right to offer a product with quality and price equal to the initial product.

 

Heavy or bulky packages:

If the order includes different products and / or bulky ones, you may receive several deliveries and / or more packages.

 

Delivery and claims:

Generally speaking, the package is shipped via Colissimo or Chronopost.

The delivery is made to the delivery address specified by the customer in the ordering process. In the absence of the consignee at the delivery made by the carrier, the driver will leave a calling card in the mailbox. The recipient will then withdraw the parcel at the specified address.

A slip is attached to your package. We advise you to keep it; it will serve as proof of delivery.

You must verify the conformity of goods delivered at the time of delivery and before signing the delivery sheet of the carrier. You must indicate on the delivery forms any handwritten reservation with your signature mentioning any anomaly which concerns the delivery (damaged ...). Such verification is considered done when you or a person of your choice, have signed the delivery note. No claims on the state of our delivered packages will be accepted afterwards.

In case of reservations, you must also confirm these reservations by registered mail to the carrier not later than three business days after receipt of the articles and send a copy of this letter to the Customer Service of JINGO Sarl whose address is mentioned in Article 10.

In case of incomplete address, wrong address, refusal of the package by the addressee or lack of information leading to an inability to deliver the product on time to the consignee, JINGO Sarl may not be retained responsible for the ultimate quality of the delivery. If this lack of information leads to a second presentation to the consignee, JINGO Sarl will be entitled to ask additional charges for the second delivery.

In the absence of a recipient, JINGO Sarl may not be retained responsible for the ultimate quality of delivery.

Any claim regarding the delivery of products has to be made within 7 days after the day of delivery. The products must be returned in their original condition (packaging, accessories...) to the address given in Article 10.

 

JINGO Sarl offers an accessible customer service during business hours by telephone, e-mail or mail.

 

Article 6. Right of withdrawal

 

The products sold can lead be refused. In accordance with article L.121-20 of the French Consumer Code, the buyer has a period of 7 days from the date of receipt of his order to return any article which does not suit him and ask for exchange or refund without penalty, except the cost of return.

Prior to any return, the customer should indicate its intention to implement its right of withdrawal to the customer service of JINGO Sarl as follows:

 

-- The customer will ask for a number of return by contacting the customer service via e-mail to customerservice@jingo.fr or by mail to the address given in Article 10. The return will take place at the same address.

-- The right of return will  be accepted only for full products in their original condition with a copy of the purchase invoice (received by mail upon confirmation of the order) informed of the return number assigned by e-mail by our customer service and the delivery sheet (attached to the delivered parcel).

 

In this case, the shipping costs are at your expense and only the purchased product will be refunded. Returned products incomplete, damaged, soiled or damaged will not be accepted.

 

Article 7. Guarantee and After-sales Service

The sold products benefit of legal guarantees. This warranty covers apparent defects and hidden flaws from the date of delivery. The only obligation of JINGO Sarl under this guarantee is, at its option, free replacement or repair of the recognized defective products without compensation or other benefit.

This guarantee does not cover damage resulting from misuse of the product or the normal wear due to its use. To benefit of the guarantee of the products you must keep the purchase invoice of the product and the delivery sheet.

Returned products for definitive return and after sales service should be sent to the after sales service whose address is mentioned in Article 10.

 

Article 8. Provisions computer and freedoms

 

The personal information is indispensable for the treatment and delivery of your orders. The process on the site www.jingo.fr requires the creation of an account in which your information is stored and protected by a password that you choose.

 

This information is strictly confidential and is intended to JINGO Sarl exclusively for the purposes of processing your orders. They will be treated in strict compliance with the clauses of the Act of January 6, 1978.

Under this Act, processing of personal data collected on the site www.jingo.fr has been declared to the CNIL and registered on 20/10/2008 under number 1324346

 

At any time you have a right to access, modify, correct or delete information about you. To exercise this right, go under "my account", login and access your personal data to correct or amend them. You can also apply to our web service,

Article 9. Intellectual Property

 

All documents, information texts, graphics, images, photographs or other content available on the site www.jingo.fr are the exclusive property of JINGO Sarl and are reserved for the use of JINGO Sarl. Accordingly, they may not be reproduced or exploited in any use  whatsoever.

Article 11. Responsibilities

The responsibility of JINGO Sarl cannot be held for all events, inconvenience or damage inherent in the use of the Internet, particularly in the event of termination of service, external intrusion or the presence of viruses.

In addition JINGO Sarl cannot be held liable for breach of contract in case of accidental situation, force majeure, disruption or total or partial strike particularly in postal services and means of transport and / or communications, flood, ' fire.

JINGO Sarl shall have no liability for any indirect damage caused by the above mentioned situations, operating loss, loss of profits, damages or expenses that may arise.

 

Article 12. Applicable law - Disputes

JINGO Ltd. is a company incorporated in France. The law which applies to our contractual relationship is the French law. In case of dispute, the French courts will have jurisdiction.
